STANDARD TERMS AND CONDITIONS FOR THE SALE OF ITEMS BY CASTLEFIELD GALLERY

Please read the following terms and conditions before making purchases from Castlefield Gallery.

1. INTRODUCTION

These terms and conditions apply to the sale to you ‘the customer’ by Castlefield Gallery of any limited edition prints, products, books or any other piece of artwork referred to from here on as the ‘Item’ by any artist, maker or author referred to from here on as the ‘Artist’ either at Castlefield Gallery’s premises or through its website or any other outlet approved by Castlefield Gallery.

2. DELIVERY AND COLLECTION

2.1 When the customer has completed their order they will receive an email from Castlefield Gallery with their order confirmation. It will state which products they have ordered, the total cost including VAT (where appropriate) and postage and packaging charges, together with delivery and invoice details. If for any reason the order cannot be processed, Castlefield Gallery will contact you within 3 working days to explain the nature of the issue. Please note Castlefield Gallery closes annually for an extended period from mid December to the second week in January. During this time Castlefield Gallery will be unable to respond to enquiries made at shop@castlefieldgallery.co.uk. Please check the Castlefield Gallery website castlefieldgallery.co.uk/visit to check exact details of winter closure and any other closure periods across the year.

2.2 Castlefield Gallery aims to dispatch all orders within 7 working days from when you place your order.

2.3 We use a pool of trusted couriers and delivery companies to fulfil delivery of products ordered through our shop. These include, but are not limited to:

2.3.1 Royal Mail – www.royalmail.com

2.3.2 UPS – ups.com

2.3.3 DPD – dpd.co.uk

2.3.4 Fedex – fedex.com

2.5. If you have not received your delivery within 14 working days of the purchase date please contact us on shop@castlefieldgallery.co.uk

2.6. Please note that Castlefield Gallery is not currently shipping ‘Items’ internationally.

2.7 Unless you and we agree otherwise, if we cannot deliver your goods within 30 days, we will:

2.7.1 let you know;

2.7.2 cancel your order; and

2.7.3 give you a refund.

2.8 The customer is responsible for the ‘Item’ as soon as delivery has taken place, any risk associated with the ‘Item’ passes to the customer from the moment they have taken possession of it.

2.9 Collection. After purchasing ‘Items’ online and selecting collection as your preferred method to receive your ‘Item’, customers must collect their ‘Item’ within 30 days of the purchase date or else they will be refunded. 3. OWNERSHIP OF THE ‘ITEMS’ COPYRIGHT

3.1 Copyright of the ‘Item’ remains the property of the ‘Artist’.

In accordance with the Copyright, Designs and Patents Act 1988, copyright and any and all other Intellectual Property rights in the ‘Item’ purchased by the customer remains the property of the ‘Artist’ (author or maker) at all times.

3.2 The Item is sold by Castlefield Gallery to the customer for non-commercial use only. By accepting these Terms and Conditions the customer acknowledges that copying or distributing images, information and other data, in whatever form and without the express written consent of its owner, may constitute infringement of one or more intellectual property laws, conventions, rules, regulations, or treaties.

4. EFFECTS OF CANCELLATION AND REFUND POLICY

4.1 Our policy lasts 30 days. If 30 days have passed since the customer collected or received the ‘Item’, unfortunately we can’t offer you a refund or exchange.

4.2 To be eligible for a return, the ‘Item’ must be returned to Castlefield Gallery unused and in the same condition that you received it. It must also be in the original packaging.

4.3 To complete your return, we require a receipt or proof of purchase.

4.4 Providing the conditions of 5.1, 5.2 and 5.3 are met we will reimburse to you all payments received from you, excluding the original costs of delivery, where applicable.

The goods must be returned “as new” in a saleable condition. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by the customer..

All agreed reimbursements will be made within 30 days after returned goods are received by Castlefield Gallery from the customer

4.5 Castlefield Gallery will make the reimbursement using the same means of payment used for the initial transaction, unless the customer and Castlefield Gallery agree otherwise.

4.6 For all returns made by post or courier, the customer should obtain a proof of postage or despatch. We cannot refund products damaged or lost in transit back to Castlefield Gallery.

5. SECURE SHOPPING

Customer payment information supplied for online transactions is used solely for the purpose of processing that transaction.

Castlefield Gallery  have partnered with Stripe, a leading payment gateway to accept credit cards payments safely and securely for our customers. Stripe manages the complex routing of sensitive customer information through credit card processing networks.

A PCI-certified auditor evaluated Stripe and certified them to PCI Service Provider Level 1. This is the most stringent level of certification available in the payments industry. This audit includes both Stripe’s Card Data Vault (CDV) and the secure software development of their integration code.

Stripe’s systems, processes, and controls are regularly audited as part of their SOC 1 and SOC 2 compliance programmes. SOC 1 and SOC 2 Type II reports are produced annually and can be provided upon request.

6. DATA PROTECTION

Castlefield Gallery may collect, hold, control, use and transmit personally identifiable information obtained from the customer  in the course of your purchase of any item. By agreeing to these Terms and Conditions you agree to such information being used in these ways and for such information to be disclosed to the Artist, as applicable, if you are in breach of your obligations under these terms and conditions.

7. LIABILITY OF CASTLEFIELD GALLERY

Castlefield Gallery makes no representation or warranty of any kind whatsoever, express or implied, in connection with any ‘Item’ sold by Castlefield Gallery. Castlefield Gallery its board of trustees, directors and employees exclude all liability (whether in contact, tort or otherwise), to the fullest extent permitted by applicable law, for any loss or damage that may result to you the customer or a third party in connection with the ‘Item’.

8. RIGHTS OF THIRD PARTIES

No person other than the customer and Castlefield Gallery have any rights under these Terms and Conditions other than in respect of paragraph 4 above which confers a benefit on the ‘Artist’ and is intended to be enforceable by the ‘Artist’, as applicable.

9. GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with this legal notice shall be subject to the exclusive jurisdiction of the English courts.
